Membership agreement

Introduction

This is an agreement between you (the “Member” or “you”) and The Gym Limited (“The Gym Group”, “The Gym”, “us”, “our”,  or “we”), a company registered in England and Wales (registration number 05659669), whose registered office is 2nd Floor, Arding & Hobbs, 7 St. John’s Road, London, SW11 1QN.

By completing the joining process at our website and becoming a member of The Gym Group, you are accepting all the terms and conditions in this membership agreement and our gym membership rules and confirming that you are 16 years or over. memberships & Day Pass Memberships are only available to those 16 years & over. You should only join as a Member if you have read and accept these terms and conditions.

Definitions

Add-on: A secondary product that you may have in addition to your membership. Special terms apply to Add-on products.

Additional services: Activities available at some local gyms undertaken by third parties, which may include self-employed personal trainers and other third-party activities which do not form part of this membership agreement. These services will be chargeable directly to the third party, offering them with no liability to The Gym Group.

Administration fee: means the fees payable by you for making any changes to your Membership.

App: The mobile application for The Gym Group members, which is available for download on the Android & Apple App stores.

Billing Cycle: The next payment date.

Cooling-off period: This is the period commencing from the membership start date to the 14th calendar day.

DD stands for Direct Debit, which is protected under the Direct Debit Guarantee.

Free freeze at no cost: Temporary suspension of your membership without cancellation with no fee.

Gym membership rules: The rules governing your conduct as set out on our website at https://www.thegymgroup.com/legal/the-gym-group-membership-rules/.

Home gym: The gym in which a member has signed up. This can be changed in the Member Area.

Joining fee: The amount you pay as part of the website joining process as a one-off fee payable for Membership.

Member Area: The online portal for members at www.thegymgroup.com/member-area

Membership amount: The price you pay for your membership, either up front during the joining process or by a monthly recurring payment method.

Membership types: Defines the memberships available at the specific gym you are enquiring about, as follows:

Off-peak membership: A membership that allows the Member to enter the gym during specified times of the day, defined as off-peak. Off-peak times are defined per gym, and details can be found on the specific gym page of your Home Gym. This membership is paid for monthly.

Paid freeze/unfreeze at a cost: Temporary suspension of your membership without cancellation. The cost of a paid freeze is displayed in the freeze membership page on the Member Area or App. Freeze or unfreeze may incur a pro-rated amount depending on the time of the month the Paid Freeze or unfreeze is initiated.

Personal training sessions: Sessions booked by you directly with an independent self-employed trainer, which do not form part of this agreement and are not provided by The Gym Group, and are subject to a separate agreement between you and the trainer.

Promotional rate/ price kicker: In relation to any monthly Membership Amount and/or the amount payable from time to time for any category of Membership, the introductory or other promotional amount you agree to pay during the introductory period. The monthly rate will revert to the full payment amount at the end of the promotional period as outlined during the joining process & welcome email.

RCC stands for Reoccurring Card Payment.

Standard Membership: A membership for one specified gym paid for monthly.

Standard Saver: A membership for one specified gym that can be purchased in 3-, 6-, 9- or 12-month durations paid up front.

Student Membership: Membership available to Students only, with a fixed duration of 3, 6, 9, or 12 months, and subject to the separate student terms and conditions set out herein.

Ultimate Membership: A membership that offers a range of additional benefits, including access to multiple gym locations, paid for monthly.

Ultimate Saver: a membership that offers a range of additional benefits, including access to multiple gym locations, all with a fixed duration of 3, 6, 9, or 12 months paid up front.

PIN: Upon joining, you will receive an 8-digit PIN via SMS & email that is unique to your membership. You can also access our gyms via our app with the use of a QR code. This PIN or QR code should not be shared or used by any other person.

Product information & starting your membership

Terms for Standard Memberships:

Allows 24/7 access to the Home Gym selected upon joining, provided your Home Gym has 24/7 access. Please note that some gyms do not have 24/7 access. Details of these gyms can be found on our website.**

Terms for Ultimate Memberships

As well as all the benefits of Standard membership and Multi Gym Add-on membership, Ultimate Membership includes the following additional benefits:

  1. Multi gym access - Choose from gyms nationwide, and you may select 4 gyms that you would like to be able to access in addition to your Home Gym at any one time, so you can work out whenever you want, wherever you are.

  2. If you visit another gym more often than your Home Gym, this will result in an additional charge if that gym’s monthly fee is higher than your Home Gym. You will be notified by email if you are subject to additional charges.

  3. Free membership freeze - sometimes life gets in the way. Ultimate Membership gives you the option to freeze your monthly membership for up to 1 month at no cost. Your freeze can be extended above 1 month, but will incur further charges.

  4. When you use the ‘Guest Pass’ benefit, you confirm that you are bringing a guest to join your training session and agree to ensure that you will both comply with The Gym Group Membership Rules. You can only invite the same guest twice each month. Unused invitations can be cancelled up to the time they have been accepted. On the 1st of every month, all invites will be refreshed, and you will have 4  new invites to use. Any unused invites at the end of the month do not rollover to the following month.

Terms for Add-ons

You may purchase the additional add-ons below when you sign up or if you are an existing member.

  1. Yanga Sports Water

  2. Guest Passes

  3. Multi-gym access.

Each is available to members at most gym locations. All gyms where any of the above are not available are specified on our website. These add-ons can be purchased as an add-on product in our online Member Area or our App. Prices may vary and may incur pro rata amounts as outlined during the online application.

Members can remove their Add-ons via the Member Area or our App, and access to those add-ons will remain until the end of that month’s billing cycle, provided that the add-ons are removed at least 4 working days before your next direct debit date, failing which you will be charged for the next month's payment for Add-ons. Following this, you will no longer have access to those removed Add-ons.

The Multi Gym Add-on (with Standard membership) allows you to select 4 gyms to access in addition to your Home Gym. This can be done online in the Member Area or our App. You may change your selections at any time, free of charge; these changes will take up to 20 minutes to come into effect. You can choose and access any of our gyms without changing your direct debit sum; however, as the price of a membership differs by gym, should you use a more expensive gym more frequently than your home gym within any month, you will receive a surcharge at the end of that month for the price difference.

If you purchase a guest pass Add-on, you can invite up to 4 guests a month to join you for a gym session. You can only invite the same guest twice each month.

Changing your membership product or home gym will remove any additional purchased Add-ons and Guest Passes, and Multi-Gym access will be removed immediately. Yanga Sports water will remain until the end of that month’s billing cycle and will need to be re-added via the Member Area or App.

Additional terms may apply for member Add-ons.

The Gym Group may choose to offer a free trial for Yanga Sports Water, Guest Pass or Multi gym access Add-ons. When this offer is available, you can subscribe to the Add-on and use the service free of charge for the designated period. After the free trial period, a new monthly direct debit commitment will automatically begin. You will need to cancel your Add-on subscription at least 4 working days before the end of your free trial to avoid being charged.

Terms for Off-Peak memberships

An Off-Peak Membership is for use only within specifically allocated times for your selected gym.

The Off-Peak times for your gym can be found on the gym page of our website or in the Member Area.

We reserve the right to change the Off-Peak times of your gym at any time. Communication will be sent to you with reasonable notice of when we are planning to do so. If the new Off-Peak times no longer work for you, then you may change your membership to Standard or Ultimate to always access the gym. This can be done in the Member Area or App.

There may be cases where an Off-Peak member can book a class within peak hours. Despite this, please note that Off-Peak members cannot attend these classes and will be turned away at the door. In order to attend classes in peak periods, you will need to upgrade your membership to Standard or Ultimate. This can be done in the Member Area or our App.

We will be monitoring all Off-Peak members’ use of the gym and the time that you arrive. If you consistently enter the gym during designated peak hours, you will receive a notification of potential misuse of your membership and be given a warning to start using the gym during the Off-Peak window. Following this notification, if you continue to use the gym outside of the Off-Peak window, we reserve the right to terminate your membership.

Terms for Saver Up Front memberships

Ultimate & Standard memberships are available for purchase at some locations for 3-, 6-, 9-, and 12-month periods.

If you purchase an Ultimate or Standard membership for any of these periods, this will  be a Saver Up Front membership and all amenities available under each membership type remain the same, except for the following:

  1. Memberships cannot be transferred.

  2. Memberships cannot be frozen.

  3. Memberships cannot be extended for non-use.

  4. Following the 14th day after your purchase, you will have no other opportunity to cancel ahead of the membership end date.

  5. Refunds will not be given for any unused memberships.

  6. Yanga is not available for  Saver Up Front memberships.

Terms for Student Memberships

To be eligible for a student membership, you must be in full- or part-time education and will be required to provide proof of this status if requested.

Terms for Corporate Memberships

If your company pays for your membership via corporate invoice, you agree to follow the rules of membership set out in this agreement. Any payment-related queries or changes to personal details will need to be discussed with your corporate membership account owner at your organisation.

If you benefit from a monthly discounted membership as a benefit from your employer, you may forfeit the right to the discount upon termination of your employment and may need to pay the full package fee for your chosen gym.

Terms for day passes

Day passes are available in 1- or 3-day options, depending on your gym. Please see our website for details on which gyms offer 1-day passes and 3-day passes.

Day passes that are 3 days need to be used consecutively from your selected start date.

Day passes are active from 12 am to 11.59 pm on the selected date and can be used multiple times on the same date.

All-day passes offer access to the “standard membership” amenities.

No refunds will be given for unused day passes.

Terms for the “YANGA sports water” Add-on

YANGA Sports Water is available to members at most gym locations. It can be purchased as an Add-on product in our online Member Area or our App. By signing up to YANGA Sports Water, you will be able to access the YANGA Sports Water machines within participating Gym locations.

YANGA Sports Water is provided by YANGA Sports Water. The Gym Group cannot be held responsible for goods and services provided by Yanga Sports Water.

After using the Yanga machine, you will need to wait 20 minutes before your next refill.

The YANGA Sports Water Add-on can be cancelled at any time by visiting our online Member Area or our App. You will need to cancel at least four (4) working days before your next billing date to avoid being charged the following month’s payment.

The Gym Group may choose to offer a free trial to YANGA Sports Water. When this offer is available, a Member can subscribe to the YANGA Sports Water Add-on and use the service free of charge for the designated period. After the free trial period, a new monthly payment commitment will automatically begin. You will need to cancel your YANGA Sports Water subscription at least four (4) working days before the end of your free trial to avoid being charged.

Using the gym

You are entitled to access and to use the gym or gyms defined by your Membership type until termination or suspension of that Membership under this Agreement.

Except where there are any circumstances outside our control preventing us from doing so, we will make available to you the rights and privileges of Membership of the gym or gyms you joined and have paid for. This includes access to the gym and gym equipment, changing areas, and staff for general advice. We will communicate with you in advance if we are unable to make available to you the rights and privileges of Membership.

To ensure appropriate use of our gyms, gym equipment and facilities, we may monitor members’ use of our gyms and compliance with our Gym Rules. If we deem your behaviour to be in breach of the Gym Rules, we will communicate to you and may give reasonable time to correct the behaviour before we take any further action. Continued misuse or breaches of the Gym Rules may result in the termination of your membership.

A General induction (kick start) is available to book in the Member Area or in the App.

For members requiring access to the accessible entrance or who are aged 16 & 17 years, a mandatory induction is required before your PIN becomes active. These can be booked in the Member Area.

If there are access limitations that require accessible door access, you may be invited to complete a personal emergency evacuation plan & may be contacted by the local gym management team.

Joining a new gym not yet open

New gyms may be subject to a pre-opening offer detailed at the point of joining and could be subject to Price Kicker, full details of which will be provided to you if this happens. Information on your Promotional Rate period will be detailed on the homepage of the gym, and we reserve the right to change the offer at any point.

We will take an initial payment from you at the point of joining, with the next payment, if opting to pay by DD or RCC, taken one month after the gym opens.

You have the right to cancel your membership at any time, allowing four (4) days’ notice. The 14-day Cooling Off Period applies 14 days from the opening date.

If joining an Ultimate Membership, your reciprocal gym access will not start until the gym opens.

The Gym Group App access will be live once the new gym is officially open.

New gym openings may offer the opportunity to view the gym before the opening date. If this is available for your gym, this will be communicated to you ahead of an opening date.

Official opening dates will be confirmed via email and online channels.

General terms

As a member of The Gym Group, you agree to keep your personal information up to date via the Member Area on the website or App.

We may, with reasonable notice and at our discretion, close our premises for reasonable periods of time to carry out maintenance, repairs, refurbishment, cleaning or for other reasons outside of our control, including at least two (2) days a year for necessary maintenance or other work. We will endeavour to reopen facilities as soon as is reasonably possible in these circumstances. You agree that you will not be eligible for any refund for the temporary interruption in services during the period.

We reserve the right to increase, reduce or withdraw certain facilities, services, or activities, as well as change opening times in any gym, either permanently or temporarily, at any time. Where possible, we will aim to give at least one (1) week’s notice of any changes.

We reserve the right to change the access privileges of members with membership packages that allow access to multiple gym locations.

Managing your membership

Changing your membership

Membership types can be changed by you. Fees may apply. Details can be found online in the Member Area or our App.

If you have a discounted Membership and you change to a new Membership product or Home Gym location, you will waive the right to the discount (or any Promotional Rate) on the original Membership and pay the outlined price on the new Membership.

If you have a discounted Membership and your Membership is terminated, you will waive the right to the discount and pay the advertised Membership Amount or monthly Membership Amount if you later choose to re-join The Gym Group.

If you change to an Ultimate Membership, your reciprocal gym selection may take 20 minutes to come into effect.

Freezing your membership

If you are an Ultimate pay monthly member, you may freeze membership for one (1) whole month in 12 months at no cost. The free freeze period starts on the next billing date of the membership, and the membership is automatically unfrozen at the end of the month. Ultimate members are required to use the Free Freeze membership option before accessing the Paid Freeze options.

If you are a Standard or Off-Peak monthly membership member, you may freeze your membership at a cost (Paid Freeze), at any time. This can be accessed through the Member Area or our App. The freeze will take effect immediately and can be cancelled at any time in the Member Area or our App. You will need to freeze at least four (4) working days before your next billing date to avoid being charged the following month’s regular payment amount. If you attempt to freeze within four (4) days of your payment date and you are then charged the full membership amount, the payment difference will not be refundable.

All Saver memberships do not have access to the freeze options and are continuous memberships throughout the paid upfront term.

When your membership is frozen, your PIN will be deactivated, and you will not have access to a gym.

When a member freezes their membership at a cost, they must reactivate their membership in the Member Area or our App. This can be done at any time, and a pro-rata payment will be taken for the remaining period before their next Billing Cycle, in which they will have access and use the gym.

If you have a discounted membership, your discounted rate will remain for the specified period after your freeze has ended.

If you have an Ultimate Membership, pay monthly, and you cancel your free freeze within the 1 month, you have used your free freeze entitlement and must subsequently pay to freeze your membership at the applicable rate.

Payment Information

If your membership has an initial payment amount, you agree to pay us the full membership amount by credit or debit card. You will be notified of any applicable membership amount, but before the online joining process is complete.

If your membership has a recurring monthly membership amount, you agree to maintain a direct debit instruction with your bank (or recurring international Credit Card payment for overseas members) for the monthly membership amount. Your first monthly membership amount is due on the date shown at the end of the online joining process (which will also be confirmed to you by email), and subsequent monthly membership payments will be due on the same day of each month until your membership is cancelled.

If the terms on which you are accepted as a member include an initial promotional rate, you agree to pay the discounted promotional rate as a recurring monthly membership amount during the introductory period specified in the promotional or introductory offer. Thereafter, we may debit for the higher standard monthly membership amount specified in the promotional offer (or such higher rate as might apply) in respect of each successive month after the introductory period has lapsed and unless or until your membership is cancelled.

We reserve the right, at our discretion, to change your monthly membership amount fee. If this happens, we will notify you by email no less than 10 working days before the change is made. You can cancel your membership within this period, as per the ‘ending your membership’ clause. If you do not cancel, the new monthly membership Amount fee will apply automatically.

You agree to pay us the monthly membership amount regardless of whether there is any temporary interruption in services during the period, foreseen or unforeseen. In circumstances where we are required to close or restrict facilities for any reason, no refunds will be due. The Gym Group will endeavour to offer an alternative gym to access where possible, but not guaranteed.

If any payment due from you is returned unpaid or not honoured, and you pay by direct debit, we will re-attempt your payment amounts 10 working days later, and this will be subject to a £15 late payment fee. If your payment fails on the 2nd attempt, your membership will be terminated, and you will be required to rejoin your selected The Gym Group location, and this may be subject to joining fees.

If you pay by recurring card payment and your payment is not successful on your scheduled billing date, we’ll automatically reattempt to take payment up to 3 more times over the next 6 days. If we’re unable to collect the payment on the final attempt, your membership will be cancelled immediately. You will be required to rejoin your selected The Gym Group location, and this may be subject to joining fees.

Managing your payments

You can use the Member Area or our App to make changes to your payment account details. All changes to payment details must be processed at least four (4) working days before your billing date, to prevent your previously registered card or bank account details from being processed.

You can use the Member Area or our App to make changes to your payment date, payment type and view payment history. Pro-rata one-off payments are taken into account for the days between your current billing date and your new future billing date. You’ll receive an email confirmation of your new payment date once this has been completed.  Restrictions may apply to your preferred billing date.

Renewing your saver or student membership

Saver and Student members will be notified when it is time to renew via email, and this will also be available to view in the Member Area.

Renewing a Saver or Student membership requires an upfront payment during the renewal period. After your renewal period & membership has lapsed, if you have not renewed within the allocated timeframe, you will be asked to re-join The Gym Group and will not benefit from any preferential renewal rates. The renewed term starts the day after the current term ends by default.

Upon renewing your membership within the allocated timeframe, your renewed membership is subject to a 14-day Cooling Off Period during which time you may cancel your membership and receive a full refund. This Cooling Off Period will lapse at the end of day 14 of your new term. This is subject to The Gym Group's standard 14-day cooling-off period terms. Outside of the 14-day cooling-off period, any termination of membership will not be eligible for a refund.

Ending your membership

If you have a monthly or pay-upfront Saver membership, you have the right to cancel this Agreement under the Consumer Rights Act 2015, Section 45, within 14 days from the date of purchase without giving any reason, but you must contact us within the 14 days at  https://support.thegymgroup.com/support/tickets/new to do so.

If you have requested an immediate membership start date and you cancel your Membership within the 14-day Cooling Off Period and you’ve not used the gym facilities, a full refund will be issued.

If you have requested an immediate membership start date and you cancel your Membership within the 14-day Cooling Off Period and you’ve used the gym facilities, proportionate charges will be due. The refunded amount will be reduced by the higher of a) one-day pass rate (for your gym at the time you request to cancel) or b) pro-rata rate based on your last gym visit within the 14-day Cooling Off Period. Refunds will be made no later than 14 working days after the member service team has confirmed the amount of your refund, and will be made using the same means of payment you used for the initial transaction.  

For direct debit payers cancelling after the 14-day Cooling Off Period, you may terminate your Membership at any time by cancelling your direct debit mandate with your bank, or by contacting our member service team here. To avoid being charged your next monthly payment, you will need to cancel your direct debit four (4) working days before your Billing Cycle. If you would like to continue using The Gym Group until the end of your billing period, please contact our member service team before cancelling your direct debit; your membership gym access will cease immediately. 

For recurring card payers cancelling after the 14-day Cooling Off Period, you may terminate your Membership at any time by contacting the member service team here. To avoid being charged your next monthly payment, you will need to contact our member service team at least four (4) working days before your Billing Cycle If you would like to continue using The Gym Group until the end of your billing period, please also state this when contacting the Member Service Team, or your membership access will cease immediately.

All cancellation requests made directly to the Member Service Team will require confirmation from the Member Service Team. If you have been contacted requesting more information, please respond to that request, as your membership will not be cancelled until you have received a confirmation.

If you have purchased a membership for a gym that has not yet opened, you have the right to cancel and receive a refund of any paid Joining Fees and membership payments before the gym officially opens. If you are cancelling after the gym opens, any refund due within the 14 days will be subject to pro-rata reduction for any usage.

If you have a Membership that gives you access to a single specified gym, and that gym closes indefinitely, this Agreement will end, and you will receive a pro-rata refund of your Membership Amount or most recently paid monthly Membership Amount, as applicable.  

We may assign the benefit of this Agreement and our rights to a third party, provided we give you notice and your rights under this Agreement will not be prejudiced.  

We may terminate this Agreement and cancel your Membership with immediate effect on notice to you if you breach any of the Gym Rules or Membership Agreement, where we consider that your membership may pose a risk to the health and/or safety of other members or staff. In this event you will no longer be able to access any of our facilities and we will not issue any refund. 

We consider the safety of our members and our staff to be paramount. We reserve the right to refuse any application for Membership if it’s been brought to our attention of past breach of the membership Gym Rules or Membership Agreement. If this happens, we will notify you of this and refund all unused Joining Fees, Administration Fees, pay up front Membership Amount or monthly Membership Amount applicable. 

Any failure by us to terminate your Membership if you breach any of The Gym Group Membership Rules, or where we give you extra time to pay if you do not pay your Joining Fee, Administration Fee, Membership Amount or monthly Membership Amount when it falls due, will not prevent us from subsequently enforcing the terms of this Agreement. 

Personal Training & 3rd party activities (additional services)

Personal Training Sessions and “additional services” do not form part of this Agreement and are not provided by The Gym Group.

Any “additional services” (including, for example, Personal Training Sessions, Sports Therapy and Massage Therapy) which you contract for or agree to pay for, do not form part of your Membership Agreement and the Terms & Conditions of this Agreement will not apply to them, however any activity on any of our gym premises will still need to be conducted in accordance with the Gym Membership Rules. You should be aware that if you enter into any agreement for “additional services”, you are agreeing with those third-party individuals and not with The Gym Group.

We do not accept any liability for any losses, damage, personal injury or other loss caused by any negligent act or omission of third parties providing the “additional services” which are specifically excluded from the Membership Agreement, and we do not accept any responsibility for the same except where precluded by law.

PT sessions are subject to separate terms and conditions with each personal trainer. Each personal trainer sets their own rates, and all fees will be payable to the personal trainer directly. The Gym Group is not responsible for the performance or delivery of any PT sessions, or for any monies exchanged between members and personal trainers.”

The Gym Group employees may provide induction services or personal reviews of your health or training needs. Such services are provided without additional charge. 

3rd party advertising may be displayed on screens in your gym but we are not responsible for such advertising.

Where gyms offer vending machines, dispensable products are the responsibility of the 3rd party and do not fall under this Membership Agreement. Any payment disputes will need to be discussed with the 3rd party provider, whose contact details will be advertised on the vending machines themselves.

Health Agreement & Liabilities

Health Agreement

You warrant, represent and acknowledge that:

The information given by you in entering this agreement is correct and will be relied upon by The Gym Group.

  1. Our staff, agents and subcontractors are not medically trained, and should you have any concerns with your health and fitness, you should seek independent medical advice before engaging in any physical activity on our premises.

  2. To the best of your knowledge and belief, you are in good health and not knowingly incapable of engaging in either active or passive exercise and that such exercise would not be detrimental to your health, safety, comfort, well-being or physical condition. Further, you will advise us immediately should your health or vulnerability to injury change.

  3. You are primarily responsible for your health, safety, and well-being, but we want to ensure that you enjoy our facilities safely. To that end, we consider that we should expect the following of each other.

  4. You must only use the gym if you are well and in good health.  

  5. For your own safety and that of others, you must always adhere to the Gym Membership Rules whilst using the gym.

Whilst we will respect your decision to follow your own training program, we reserve the right to ask you not to exercise beyond what we reasonably believe to be your personal ability. Similarly, if we deem you are training in a manner which is at the detriment of your own safety or that of others.

We shall endeavour to maintain a safe environment for you to enjoy your exercise.

We shall endeavour to ensure that our fitness trainers and staff are qualified to fitness industry standards.

You shall inform us upon joining or as soon as practical after you are made aware of any disabilities or health conditions to enable us to mutually agree on any reasonable adjustments to ensure your safety.

If you do have a disability or health condition, we require you to have an induction at your Home Gym to ensure we mutually agree upon any reasonable adjustments to support your safety and overall gym experience. This will include the production of a Personal Emergency Evacuation Plan [PEEP] if you have a disability or health condition which affects your mobility.

We shall endeavour to ensure that any reasonable adjustments that are agreed between you and us and that these are reviewed regularly to ensure they remain fit for purpose.

We shall always keep confidential any information that you give us regarding your health in line with current data protection legislation.

Managing permissions & data

There are certain email and SMS communications that are necessary for us to send to all members, in connection with their membership. To do so, we will process your personal data for the purposes of performing our contractual obligations to you under the terms of your membership. You cannot opt out of these communications. You may opt out of email and SMS communications that we may otherwise send for promotional or marketing purposes, but if you do, we cannot be held responsible for any loss incurred by you not receiving gym-related communications. For the safety and security of you, our other members and our staff, and for associated purposes of crime prevention and detection, we operate 24-hour CCTV security at all our gyms. The images will be captured, processed, and retained in accordance with our separate privacy, CCTV & cookie policy, available at https://www.thegymgroup.com/privacy-cookie-policy/. Access to such footage will also be governed by the provisions of that policy.

We will securely store personal data, including membership information and recorded CCTV footage, in accordance with our privacy policy, which is available at https://www.thegymgroup.com/privacy-cookie-policy/

Photos & videos

You are welcome to take photographs and video recordings on the gym floor for your own personal use. Please make sure to stick to these rules and any extra rules displayed on the gym floor:

  1. Anyone who appears in your photographs or videos must be aware that you are filming them, so make sure to ask their permission first.

  2. If you are taking photos or recording videos of yourself in our changing rooms, please make sure you don’t capture images of another member.

  3. If another person feels unhappy or uncomfortable that you are filming them and makes a complaint to us, we may ask you to show us any images which you have taken in the gym and to delete them if appropriate.

  4. If a member of our team asks you to stop filming or taking photographs, please make sure you do.

Please make sure you never post photographs or videos you have taken on The Gym Group premises on any social media platform with other identifiable people in them, without getting explicit consent from all persons concerned.

Insurance & liability

Only you, the person named in the online joining process, can benefit from this agreement.

If any of the terms of this agreement are found to be invalid, unenforceable or illegal, the remaining terms will still be enforced.

The Gym Limited, its parent companies, its agents, employees and subcontractors are not liable for any loss, damage or theft of any of the property that you bring onto any of our premises.

We cannot be held liable for any criminal acts carried out by a person who is not a direct employee of The Gym Group.

We may make reasonable changes to The Gym Group membership rules and the membership agreement at any time. It is your responsibility to check online at regular intervals for changes to these documents.

This Agreement is governed by the laws of England and Wales.

Member satisfaction survey

From time to time, we may choose to invite some of our members to participate in a survey of satisfaction. This invitation will usually be sent by email.

At our discretion, member satisfaction survey participation may be associated with a prize draw offering cash prizes of varying amounts to participants. Members who respond to such an invitation by completing the satisfaction survey by the advertised closing date will be entered into the draw.

Eligible participants will only be entered once into a particular draw. A winner will be chosen at random from all entrants to that draw within 90 days of the closing date. Winners will be contacted after the prize is drawn to arrange receipt of the prize.

Membership agreement & gym rules

We reserve the right to make changes to Gym Rules and the Membership Agreement at any time, and we will bring all such changes to your attention. It is your responsibility to check online at regular intervals for changes to these documents.
